  1. What is the purpose of this Privacy Policy? 

By means of this privacy policy (hereinafter, the “Privacy Policy“) Proteos wishes to inform users (hereinafter, the “User” or, where applicable, the “Users“) who browse and access the website: https://www.proteosbiotech.com (hereinafter, the “Website“) that the personal data provided by the User through the Website, as well as any other data derived from their browsing, will be processed by Proteos.

3. What data must be provided? 

The data requested on the Website are generally mandatory, unless otherwise specified in the required field, to comply with the purposes for which they are being requested. Failure to complete the information with the required personal data or doing so partially may mean that PROTEOS will not be able to attend to the requests or services requested by the User. 

In this sense, the personal data provided by the User to PROTEOS must be true, accurate and current, in such a way that the information contained in the records is up to date and does not contain errors. Thus, the User will be liable for the veracity of the data provided and for any damages that this may cause to PROTEOS or third parties.  

Likewise, where applicable, the User guarantees that he/she has informed the third parties from whom he/she provides his/her data of the aspects contained in this Privacy Policy. Furthermore, the User guarantees that he/she has obtained their authorisation to provide his/her data to PROTEOS for the purposes indicated in section five of this Privacy Policy. 

 

4. What is the source of the User’s data? 

PROTEOS will only process data that have been provided directly by the User: either through the different data collection forms on the Website or through browsing. 

 

5. For what purposes and on what grounds do we process the User’s data? 

PROTEOS will process the User’s personal data in accordance with the following purposes and legal bases:

To submit scientific information on PROTEOS products and services, as well as those of PROTEOS’ third-party collaborators, by electronic and conventional means. 

The express consent of the User by ticking the box provided for this purpose on the data collection form on the Website. 

You can revoke your consent by sending an email to the address: unsubscribe@pbserum.com indicating in the subject line, “I do not want to receive advertising“. 

3.- To handle applications to participate in PROTEOS’ selection processes. 

To handle the applications sent via e-mail or the form provided for this purpose on the Website, including, where appropriate, the processing of the User’s references, as well as notifying the User of current or future personnel selection processes that may be of interest to the User.  

 

The implementation of pre-contractual measures at the request of the data subject, which shall be deemed to have been granted when submitting his or her curriculum vitae.  

The consent of the User, in case the User is interested in being part of the PROTEOS database. 

4.- To carry out internal analyses in order to improve the quality of the service. 

Statistics will be collected in order to improve the services offered by PROTEOS through the Website.

5.- To comply with the legally established obligations. 

When the processing is necessary to comply with a legal obligation. For example, in relation to certain information that may be required by health authorities: Spanish Medicines Agency, Ministry of Health, among others.

6. With whom will we share the User’s personal data? 

In certain cases, PROTEOS may share certain information with third parties. In particular, your personal data may be transmitted to: 

Public Administrations, when legally required to do so, based on compliance with a legal obligation. For example, Health Administrations: Spanish Agency of Medicines and Medical Devices (AEMPS), Ministry of Health, etc. 

To the Courts and/or Tribunals, in the cases provided for by law, on the basis of compliance with a legal obligation. 

In addition, certain organisations or professionals who provide services to PROTEOS, as processors, such as IT support companies, or communication and marketing agencies, may have access to your data on behalf of PROTEOS.  

 

7. What categories of personal data are processed and for how long will we keep them? 

PROTEOS will process and store the following categories of personal data of the User, based on the retention criteria mentioned below:

In relation to requests made by a User with whom there is no pre-contractual relationship, the data will be retained until the request has been resolved, and in any case, when the User revokes his or her consent.  

 

In the event of a pre-contractual relationship with the User, the data will be kept for the duration of the relationship and, beyond that, duly locked for the applicable statute of limitations. 

2.- To send communications of a scientific and/or promotional nature to Users who are distributors or healthcare professionals. 

  • Identification data: name and surname. 
  • Contact details: e-mail address, telephone number. 

 

The data provided will be kept until the User revokes his or her consent, and will be locked until the legal responsibilities expire, after which they will be deleted. 

3.- To handle applications to participate in PROTEOS’ selection processes. 

 

  • Identification data: name and surname. 
  • Contact details: e-mail address, telephone number and postal address. 
  • Employment data: profession, previous employment. 
  • Education data: training. 
  • Third-party data: references. 

The data will be kept for a period of 1 year from the end of the selection process; unless the User consents for his/her data to be kept for a longer period of time. 

 

4.- To carry out internal analyses in order to improve the quality of the service. 

 

Data relating to the User’s browsing on the Website. For example, the IP address. 

The data will be kept for 11 months and then deleted. 

5.-To comply with the legally established obligations. 

Data that may be legally required. 

The data will only be kept for as long as necessary to fulfil the legal obligation and will then be deleted. 

 

 

8. Will international tranfers be made?

PROTEOS informs the User that it does not currently carry out international data transfers to third countries outside the European Union.  

However, in the event of future use, the User will be informed and all the necessary safeguards required by data protection regulations will be adopted. 

9. Does PROTEOS make automated decisions? 

No automated individual decisions will be taken which have legal effects on the User or which would significantly affect the User in a similar way.

RIGHT OF ACCESS 

The right to confirm whether or not PROTEOS processes the User’s personal data and, if so, to request access to such data. 

RIGHT OF RECTIFICATION 

The right to have your data rectified if it is inaccurate or incomplete. 

RIGHT OF ERASURE 

The right to have his/her data no longer processed and deleted by PROTEOS, when the data are no longer necessary for the purposes for which they were collected, the User has revoked his/her consent or objects to the processing, among other reasons. 

RIGHT TO RESTRICTION OF PROCESSING 

The right to cease the processing of the User’s data in such a way as to prevent the processing by PROTEOS, in which case PROTEOS will only retain the data for the purpose of defending claims. 

RIGHT OF OBJECTION 

In certain circumstances, for reasons related to the User’s particular situation, and provided that the processing is based on the legitimate interest of PROTEOS or a third party, the User will have the right to object to the processing. PROTEOS will then stop processing the data, keeping them only for the exercise or defence of claims. 

RIGHT TO DATA PORTABILITY 

The right to receive the data provided to PROTEOS in a structured, commonly used and machine-readable format. You may also request PROTEOS to transmit the data to the data controller indicated by the User. 

This right may only be exercised when the legal basis for the processing of the User data is consent or the performance of a contract or the implementation of pre-contractual measures at the request of the User. 

RIGHT TO WITHDRAW CONSENT 

The right to withdraw the consent previously given, and to have their data no longer processed for a specific purpose, without affecting the lawfulness of the previous processing, based on the consent, prior to its withdrawal. 

THE RIGHT NOT TO BE SUBJECT TO AUTOMATED DECISIONS 

In the case of automated decisions, including profiling, the User shall have the right to obtain human intervention from PROTEOS, as well as the right to express his/her point of view and to challenge the decision.

11. Updates and changes to the Privacy Policy 

PROTEOS will periodically review this Privacy Policy. This update will be made public and will be communicated directly to the User in the event that its modification affects his or her rights and freedoms. The User is recommended to periodically read the Privacy Policy. 

12. Acceptance of Privacy Policy 

After reading this Privacy Policy, the User declares that he/she has been informed of the details of the processing of his/her data and accepts its contents.
